Terms of Service

The service at givenchy.baby (the “Service”) is run by [Legal name of company or person], [Full postal address] (“we”, “us”). Full details are in our Legal Notice. By uploading to or creating an account on the Service, you agree to these Terms, the Acceptable Use Policy and the Copyright Policy. Our Privacy Policy explains how we handle personal data. It is information for you, not a contract you have to agree to.

You must be at least 16 years old. If you use the Service for a business or other organisation, you confirm that you are allowed to accept these Terms on its behalf. You can’t use the Service if the law, or a previous ban from us that is still in effect, prohibits you from doing so.

You can upload without an account where we offer that option. Without an account, you may be unable to manage or delete an upload unless you keep the deletion link or token we give you.

If you create an account, give accurate details, keep your password and API tokens safe, and tell us promptly at abuse@givenchy.baby if you think someone else has accessed your account. We can’t reset or recover what we can’t verify belongs to you.

You keep all rights you have in what you upload. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit and display your content, and to make the technical changes needed to do so (such as removing metadata or creating thumbnails), only for running, securing and providing the Service.

This licence ends when your content is deleted, apart from short-lived copies in backups and caches, and copies we must keep by law or to deal with a legal claim. See the retention section of the Privacy Policy.

You promise that you have the right to upload your content, including permission from identifiable people where the law requires it, and that sharing it through the Service doesn’t break the law or anyone’s rights.

Anyone who has a link can view the image, and can copy or re-share it. Search engines and other services may also find links that are posted publicly. Don’t upload anything you need to keep confidential. Deleting an upload from the Service can’t remove copies other people have already made.

If you set an expiry time, the public link stops working when it is reached, normally [within 24 hours]. Remaining copies in backups are removed on the schedule in the Privacy Policy. Expiry is a convenience and doesn’t guarantee that nobody has saved a copy.

We don’t review every upload in advance. We act on reports and may use the tools described in the Privacy Policy to detect illegal content and abuse. We may remove content, restrict links, or suspend or close accounts that break these Terms or the law. We act carefully and proportionately, with regard to the rights of everyone involved, including freedom of expression.

Unless the law prevents it or the content is deceptive, high-volume commercial spam, we will tell you what we restricted, why, on what legal or contractual ground, whether automated means were used, and how you can challenge it. To do so, reply to the notice or write to abuse@givenchy.baby within six months. A person, not only an automated system, will review your complaint. EU users may also be able to use a certified out-of-court dispute settlement body or go to court.

This section applies only if we offer, and you buy, a paid plan. Prices, what is included and the billing period are shown before you pay, with any taxes included for consumers. Subscriptions renew until cancelled. You can cancel at any time in your account, effective at the end of the paid period, and we will remind you before renewal where the law requires it.

EU and UK consumers: right to withdraw. You can withdraw from a purchase within 14 days of buying it, without giving a reason, by telling us clearly at legal@givenchy.baby. We refund you within 14 days using the same payment method. If you asked us to start the Service during that period, we may keep a proportionate amount for the part already provided. If you expressly agreed to immediate performance of a one-off digital service and acknowledged that you would lose this right, the right ends once the service has been fully performed.

Lifetime plans. A lifetime plan is one payment with no renewals. “Lifetime” means for as long as we operate the Service, not your lifetime, and the limits shown for the plan at purchase continue to apply. If we decide to close the Service, we’ll give you at least [30 days] notice so you can download your content. Your legal rights as a consumer aren’t affected.

If we raise prices, we’ll give you at least [30 days] notice, and you can cancel before the new price applies.

Keep your API tokens secret. Follow any published rate limits, and don’t use automation to get around limits, bans or security measures. We may limit traffic that puts the Service or other users at risk.

We work to keep the Service available and secure, but it can be interrupted by maintenance or events we don’t control. Unless a paid plan says otherwise, we don’t promise a specific uptime or that uploads will be kept forever, so keep your own copies of anything important.

We may change or stop features. If a change materially affects you negatively, we’ll give reasonable notice, and if you have a paid plan and the change is more than minor, you can end it and get a refund of the unused period. If we close the Service, we’ll try to give you reasonable time to download your content.

Nothing in these Terms limits liability that can’t legally be limited. This includes liability for death or personal injury caused by negligence, fraud, intent or gross negligence, and your statutory rights as a consumer, such as your right to a digital service that conforms to the contract.

If you are a consumer, we are liable for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care. We aren’t liable for loss that wasn’t foreseeable, or that we didn’t cause.

If you use the Service for business, to the extent the law allows, the Service is provided “as is”, we aren’t liable for indirect loss, lost profits or lost data, and our total liability is limited to the greater of the amount you paid us in the previous 12 months or 100 euros. You’ll compensate us for third-party claims caused by your content or your breach of these Terms.

You can stop using the Service and delete your account at any time. We may suspend or end your access for a serious or repeated breach, or where the law requires it. In other cases, we’ll give you at least [30 days] notice. When your account ends, we delete your content as described in the Privacy Policy. If we end a paid plan without you having breached these Terms, we refund the unused period.

We may update these Terms when the Service or the law changes. For material changes, we’ll notify account holders at least [30 days] in advance, unless a legal or urgent security reason requires a shorter period. If you don’t agree, you can stop using the Service and close your account before the change takes effect.

These Terms are governed by the law of [Country whose law governs the Terms], and disputes go to [Courts of a city or country]. If you are a consumer, this doesn’t take away the mandatory protections of the country where you live, and you can bring a claim in the courts there.

Please contact us first at legal@givenchy.baby so we can try to sort things out. We aren’t obliged to take part in consumer arbitration or mediation unless the law requires it. If part of these Terms is found invalid, the rest continues to apply.
