Effective: [Effective date]
The short version

- Accounts that infringe repeatedly are closed.
- Knowingly false claims can make you liable for damages.
This summary is here to help you. The full text below is what applies.
How we protect your data
- Encrypted storage
- Images, usernames and email addresses are encrypted whenever they are stored. Passwords are kept only as salted hashes, so nobody can read them, including our founder and developers.
- No routine staff access
- Our founder, developers and staff don’t browse your images or account details. Access happens only when needed to act on a report of illegal content, comply with a legal order or fix a security problem, and each access is logged. Anyone with an image’s link can view it, and usernames are shown publicly.
- IP addresses, only to protect the service
- We hold your IP address and approximate location, worked out from that IP address, to protect our systems from flooding and similar attacks. They are erased as soon as you log out or your visit ends, meaning [30 minutes] without activity. We keep them longer only if they are linked to an attack, a report of illegal content or a legal order.

01Sending a takedown notice
Send your notice to our designated agent, below. Under the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), it must include:
- A physical or electronic signature of the rights owner or someone authorised to act for them
- The copyrighted work you say has been infringed
- The exact link of the material on givenchy.baby, so that we can find it
- Your name, postal address, phone number and email address
- A statement that you believe in good faith that the use isn’t authorised by the owner, its agent or the law
- A statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the owner
Please think about fair use and other exceptions before you send a notice. Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing can make you liable for damages.
02Our designated agent
[DMCA agent name and address, as registered with the US Copyright Office]
Email: copyright@givenchy.baby
03What happens next
If your notice is complete, we’ll promptly remove or disable access to the material and tell the uploader, including what was claimed so that they can respond. Notices can be forwarded with your contact details so that the uploader can respond, and you should expect this when you send one.
04Sending a counter-notice
If you believe your content was removed by mistake or misidentified, send our agent a counter-notice under 17 U.S.C. § 512(g)(3) with:
- Your physical or electronic signature
- The removed material and the link where it appeared
- A statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification
- Your name, address and phone number
- Your consent to the jurisdiction of the US federal district court for your address (or, if you are outside the US, any district where we can be found), and that you’ll accept service of process from the person who sent the notice
We’ll forward it to the person who sent the notice. Unless they tell us within 10 business days that they have filed a court action, we restore the material within 10 to 14 business days of receiving your counter-notice.
05Repeat infringers
We close the accounts of people who repeatedly infringe, in appropriate circumstances, and may block further uploads from them.
06Rights holders outside the US
You don’t have to rely on the DMCA. Under the EU Digital Services Act (Art. 16) and similar laws, you can report infringement of copyright, trademarks or other rights to copyright@givenchy.baby, with the link, why the content is unlawful, your name and email address, and a statement of good faith. If we act on it, the uploader gets our reasons and can challenge the decision.
